Utah Escalates Legal War Against Prediction Market Kalshi

Utah prosecutors have filed 14 criminal charges against Kalshi and its top executives, alleging the prediction market platform violates state anti-gambling statutes. The move targets CEO Tarek Mansour and COO Luana Lopes Lara, signaling a sharp escalation in the state’s ongoing campaign to shutter the platform’s operations within its borders.

The state’s case includes 12 counts of illegally promoting online gambling, intensifying a nationwide friction between prediction markets and local authorities. While Kalshi maintains the charges constitute a "crazy overreach" and intends to challenge them in court, it faces a growing list of adversaries. New York, Nevada, New Mexico, Washington, and Connecticut have already initiated legal action against the firm, mirroring similar state-level scrutiny directed at competitor Polymarket.

This localized crackdown arrives as federal regulators and state governments clash over oversight authority. The Commodity Futures Trading Commission insists it holds exclusive jurisdiction over these markets, yet recent rulings from federal appeals courts have provided states with significant leverage to pursue their own regulatory agendas. With the 3rd Circuit Court of Appeals ruling that the CFTC maintains primacy in New Jersey, the conflict is increasingly likely to reach the Supreme Court. Kalshi remains defiant, citing a previous federal court victory in Arizona as a blueprint for its defense against Utah’s current indictment.
